Washington D.C. – In response to the Federal Communications Commission (FCC) voting to approve a Second Further Notice of Proposed Rulemaking, to comprehensively reform interstate and intrastate inmate calling services for prisons and detention facilities, civil rights, media justice, and labor groups released the following statement:

“The FCC’s plan to address the cost of local telephone calls to prison, jails and immigration detention facilities is another step toward reducing the unfair financial burden on incarcerated people and their families. We applaud Chairman Wheeler and Commissioner Clyburn’s leadership to ensure that inmates can maintain contact withparents and grandparents, children, spouses, siblings, clergy and friends.

Preserving the most reliable way for inmates to keep relationships that matter is one of the best ways to ensure our communities are safer and to decrease re-offenses and reentry into the criminal justice system.

By taking further action, the FCC can finish the job and eliminate predatory phone rates entirely. The agency has an opportunity to increase transparency in an industry that profits from outrageous fees at the expense of families and address the terrible situation facing inmates with disabilities who often cannot communicate with the outside world.

The civil rights, media justice, and labor community stands behind Wheeler and Clyburn because all families deserve the right to stay connected at reasonable and fair rates, as mandated by the Communications Act.  We look forward to rapid completion of this next phase of the FCC’s work."

FCC Chairman Wheeler Highlights Need for Greater Broadband Access and Diversity in Media Ownership

Federal Communications Commission Chairman Tom Wheeler Tuesday pledged to improve the rates of media ownership by women and persons of color during his tenure as chairman, and said he was treating the commission's open Internet rules as "the most important decision of my term."

Wheeler's remarks came as he delivered the 32nd Annual Everett C. Parker Ethics in Telecommunications Lecture at the Newseum in Washington.

The event, sponsored by the United Church of Christ's Office of Communication, Inc., was held in partnership with the Newseum Institute this year to mark the 50th anniversary of Rev. Dr. Parker's ground-breaking petition to the FCC. The petition, filed at the height of the civil rights movement, challenged the television license of WLBT in Jackson, Mississippi, for its failure to cover its African-American viewers. The petition ultimately led the FCC to strip the station owners of their license, and established the right of individual citizens to petition the agency.

"Everett Parker fought for the free flow of information without economic obstruction," Wheeler said. ".…The history of America is the history of unpopular ideas that came to be recognized as essential truths – from the independence of colonies, to the abolition of slavery, to the simple notion that people should not be judged on the basis of race, ethnicity or sexual orientation. This is why free expression is a value that stands at the center of our work to promote an open Internet."

The chairman observed that the Internet also represents "an unprecedented expansion of economic opportunity. Networks have always been the backbone of economic expansion, but what is new this time is that an open Internet allows innovative economic activity to reach scope and scale at an unprecedented rate. "

Wheeler noted that ensuring universal access to the Internet for all "will not be an easy task." But, he added, "The costs of digital exclusion are significant for the non-connected and for our nation. Broadband is the gateway that facilitates, among other things, online learning, telework, remote health care monitoring, social networking, news and entertainment programming and economic opportunities. Like access to broadcasting in the 1960's, access to the broadband Internet is critical to full and fair participation in our society and our economy." Tom Wheeler remarks as prepared for delivery.

Makani Themba & Catherine J.K. Sandoval

At the event, Makani Themba, executive director of The Praxis Project, received the Everett C. Parker Award in recognition of her many years of leadership and support for promoting the public interest in telecommunications and the media.

Themba described Rev. Parker as one of her heroes, asserting, “there can be no justice when people are silent.” Themba recited the names of African-Americans whose deaths had made headlines--in the civil right era and in recent months, then added, "There are so many names we don't even know. And they number into the millions, over centuries, as we are reminded over and over again that for people of color in this country, our lives are cheap. Continuing the legacy of Rev. Parker is to break the complicity of media--especially news media--with our dehumanization. Of course, media bias does not pull the trigger, but it does help paint a target on our backs." California Public Utilities Commissioner Catherine J.K. Sandoval received the Donald H. McGannon Award for her contributions in advancing the roles of women and persons of color in the media. Sandoval directed the FCC's Office of Communications Business Opportunities in the late 1990s before becoming the first Latino member of the CPUC.

Sandoval recalled that as a 6-year-old living in a trailer park in Los Angeles, television "ignited my dreams to be a lawyer," bringing images of leaders such as Supreme Court Justice Thurgood Marshall into her home. In her remarks, Sandoval described how bringing telephone service to previously unserved parts of the Yurok tribe's reservation in California—"where the nearest cell phone service is 45 minutes away"—had enabled residents to alert emergency personnel to a wildfire outbreak and brought news to a blind member of the tribe.

The Parker Lecture was created in 1982 to recognize the founder of OC, Inc., and his pioneering work as an advocate for the public's rights in broadcasting. This year's lecture was held in conjunction with the Newseum's three-year exhibit "Civil Rights at 50," chronicling major developments in the civil rights movement from 1963 to 1965 through news media reports.

The Cleveland-based United Church of Christ, a Protestant denomination with more than 1 million members and nearly 5,200 local congregations nationwide, recognizes the unique power of the media to shape public understanding and thus society as a whole. Remarks of Tom Wheeler

32nd Annual Everett C. Parker Ethics in Telecommunications Lecture October 7, 2014

Thank you Pastor Edmonds for that introduction. Congratulations to Makani Themba and Commissioner Cathy Sandoval for your well-deserved recognition.

It is an honor to follow Reverend Truman Parker – following a Parker is natural for all of us, and that, in part, is what I’d like to address today.

There are multiple reasons why it is a privilege to be here, but I want to highlight two.

First, I grew up in a UCC church. The church is one that in its own words “joins faith with action.” This call to action challenges us to search for social justice. Everett Parker took that challenge to the parochial corners of telecommunications policy.

Secondly, I knew Everett Parker. Not well, but in the late 1970s we both advocated for diversity of voices in media. I was doing it for the cable television industry, which had an obvious interest in overcoming the restrictive rules imposed by the FCC. Rev. Parker did it because diversity of choice and diversity of opportunity was what he was all about.

Today we celebrate Rev. Everett Parker’s service to God and his contribution to our society. When he appealed the FCC’s 1965 decision to grant WLBT’s license renewal in United Church of Christ v. FCC, he not only took on racism, but also he established the landmark precedent that gave ordinary citizens the right, for the first time, to participate in FCC proceedings.

The fact that today all FCC processes are open and that anyone can provide comments on the topics we discuss is a tremendous legacy that we too often take for granted.

Before this decision, the FCC’s position was that only those alleging “economic injury and electrical interference” had the right to challenge its licensing decisions

But Chief Judge, and soon-to-be Chief Justice, Warren Burger wrote a powerful opinion that said that the public played an important role as “private attorneys general” in helping the FCC enforce the public interest standard.

I have often said that the networks that connect us are the forces that define us – not just our commerce, but also our culture and individual lives. Everett Parker gave us all a voice in the policy related to that defining force.

At the FCC we are the public’s representative in this communications revolution. Fighting for the public interest as technology transforms our economy and society is the FCC’s Number One job responsibility.

And we’ve got our work cut out for us.

At the time of Reverend Parker’s campaign, broadcast TV and radio were by far and away the most powerful sources for news and information. Fifty years after Everett Parker filed the petition that would transform access to broadcasting there is a new platform that is redefining not only access to news and information, but also access to economic opportunity and growth. Of course, I’m talking about the Internet.

Ensuring universal access to the Internet for all will not be an easy task. Nearly 30% of Americans are not connected to high-speed broadband Internet at home. This includes nearly 14 million Americans that have no access whatsoever.

Low-income individuals and people of color are disproportionately offline, and they are unconnected for a variety of reasons: cost, a dearth of relevant content, lack of digital literacy, or a mixture of the above.

The costs of digital exclusion are significant for the non-connected and for our nation.

Broadband is the gateway that facilitates, among other things, online learning, telework, remote health care monitoring, social networking, news and entertainment programming and economic opportunities. Like access to broadcasting in the 1960’s, access to the broadband Internet is critical to full and fair participation in our society and our economy.

In 2014, opportunity for all requires broadband for all.

So what should we be doing to advance the public interest and ensure that all Americans are enjoying the benefits of high-speed broadband?

Let me answer that question of what we should do by telling you some of the things I believe, and how the Commission is acting on those beliefs.

First, I believe that advancing the public interest starts with facilitating dynamic technological change to ensure the U.S. has world-class communications networks.

As many of you know, I’m a student of history. One lesson is that the opportunities created by new networks are always met with resistance. Some resistance comes from economic incumbents threatened. Some of the resistance stems from human nature. Let’s be honest; change is hard. And it’s fair to say that broadband Internet – wired and wireless – is a disruptive force that’s changing almost every aspect of our economy and our society.

But history also tells us that those who embrace change are the ones who write the future.

We need to facilitate change by promoting the world’s best innovation infrastructure. We need faster, affordable networks in more places. I don’t know about you, but I’m tired of seeing the charts of where the U.S. ranks in comparison to the broadband speeds of other nations. Table stakes for the 21st century is 25 Mbps, and winning the game means that all consumers can get at least 100 Mbps – and more.

At a time when technological advances are moving at lightning speed, competition that forces companies to embrace those advances is the best way to achieve those goals. Unfortunately, today there is an inverse relationship between competition and broadband speed. Three-quarters of American homes have no competitive choice at 25 Mbps. That includes almost 20 percent who have no option at all at those speeds!

To address this gap, I outlined an Agenda for Broadband Competition, which states that where competition exists, the Commission will protect it. Where greater competition can exist, we will incent it. And where competition cannot exist, we will take on the responsibility of promoting broadband deployment.

When we talk about broadband, we are increasingly talking about mobile connectivity. And as the Pew Research Internet Project has found, people of limited economic means and people of color disproportionately rely on mobile phones for broadband Internet access. The 21st century will be defined by the networks that marry the ever-increasing computing power of Moore’s Law with the invisible delivery of wireless spectrum. That’s why the FCC is pursuing a comprehensive agenda to make more spectrum available for broadband, including for small businesses and minority entrepreneurs.

Embracing the future also means focusing on the opportunities created by our new network realities, rather than simply refighting the struggles of the past.

Case in point: look at media ownership. This was at the center of Everett Parker’s fight 50 years ago, and it’s still an important issue today. As many of you know, in recent years, we saw covert consolidation in the broadcast television industry as major corporations used so-called sidecar agreements to do an end-run around the FCC’s media ownership limits. The result was a reduction in the number of ownership opportunities for women and minorities. In March, the FCC cracked down on these sidecar deals. I’m pleased that as a result of these new rules, new opportunities are being opened for minority and women ownership. When Gray Television, for instance, was unable to gain our approval to continue the old ways, they sold six full-power TV stations to new minority and female owners.

That’s great news, but the reality is that – thanks to new broadband technologies – facilities ownership is less critical to diverse voices than ever before. Yes, we will continue to push for diversity in ownership. But, just as important in the Internet Age, we need to exploit our new networks for ownership diversity and content diversity.

So I believe we need to embrace and facilitate the changes made possible by broadband revolution, which brings me to my second point.

While network technologies have changed, the principles that define the relationship between those who build and own our communications networks and those who use them have not. Advancing the public interest requires ensuring that our networks reflect our civic values.

At the beginning of my term, I spoke about the Network Compact, those immutable values that have formed the foundation of our communications networks for over a century. These principles include:

• Access – both to networks and on networks,
• Interconnection – by definition a network is a series ofconnections; in the broadband world, the Internet isn’t a thing,

  but a connected collection of networks,

• Consumer protection – technology has pushed the laws ofphysics, but nothing has changed the laws of human nature or

  economics, and consumers must be protected from exploitation,

• Public safety –without a doubt, this must be the underlyingdeliverable of all networks, and
• National security – in a world in which networks are now attackvectors, we must have secure and safe connectivity.

Telephone companies are retiring their old networks – which primarily run over copper — and are moving to internet protocol or “IP” networks that use a variety of means of transmission, including fiber and wireless. This transition raises a multitude of questions: What obligations will attach in an all-IP environment? Will 911 calls be required to go through with the same reliability as old landline networks? Will carriers be responsible to serve the remotest areas or the poorest populations? What about disability access and protections against privacy violations and fraudulent billing?

There are those who argue that the move from analog networks to IP networks changes the principles of the Network Compact. They are wrong. The form these responsibilities take may change in an IP world, but the principles do not – and should never – go away.

While our principles remain constant in the face of change, our policies to protect those principles cannot. I believe that to serve the public interest government oversight must evolve to reflect changes in technology.

Which brings us back to Rev. Parker. In the last half of the last century he fought for the public interest in the then-dominant communications technology. Today, at the beginning of the 21st century, we must transition his fight to the new communications technology.

The fight for the diversity of viewpoints and the protection of fundamental democratic values has leapt to the Internet. The opportunity the Internet offers for making everyone a publisher with their own outlet to the world – literally the world – is the greatest advance in democratic values in history. But it only works if the Internet remains open.

Everett Parker’s fight began when a Mississippi television station chose to go dark rather than broadcast information about racial justice. Rev. Parker fought to see that there were consequences to that activity and that the people’s airwaves were not manipulated in such a manner.

Today our challenge is to ensure that the Internet remains open to new ideas, new people expressing themselves, and new economic opportunity.

The history of networks – whether the railroad, telegraph, or telephone – has been one where the incredible opportunity presented to society is tempered by the reality of economic opportunism.

Everett Parker fought for the free flow of information without economic obstruction. In his time it was necessary to own a broadcast license or buy ink in 50-gallon barrels for your newspaper in order to have a conduit for widespread expression. Today you just need an Internet connection. That connection must be able to lead you and your opinions to the world, as well as bring the thoughts and ideas of the world to you – both without interference.

Free expression is the basis on which our democracy is constructed. We have learned that financial interests can under-value the importance of speech. But we will not. We will recognize the importance of the speaker. Just as importantly, we will recognize the importance of the listener to receive information. Democracy cannot work if political expression is

cabined and confined. The history of America is the history of unpopular ideas that came to be recognized as essential truths – from the independence of colonies, to the abolition of slavery, to the simple notion that people should not be judged on the basis of race, ethnicity or sexual orientation. This is why free expression is a value that stands at the center of our work to promote an open Internet. As if the revolutionary expansion of free speech represented by the Internet isn’t enough, the Net is also an unprecedented expansion of economic opportunity. Networks have always been the backbone of economic expansion, but what is new this time is that an open Internet allows innovative economic activity to reach scope and scale at an unprecedented rate.

These are the fundamental reasons that we are considering Open Internet rules at the FCC. Some have remarked that this may be the most important decision to be made during my term. I don’t know whether that is true or not, but I can assure you that I am treating it that way.

Everett Parker was motivated by a dream that the principal means of communications in this country would serve everybody, regardless of the color of their skin or the size of their paycheck. His work continues today. It is in that spirit that I am proud to accept your kind recognition.

I am deeply, deeply honored to receive this recognition named for one of my personal heroes, Rev. Rverett C. Parker. and in 2014, the 50th anniversary of the challenge filed against the license of WLBT in Jackson, MS? Just amazing! when Rev. Parker, Aaron Henry and Rev. R.l.T. Smith filed that challenge 50 years ago, you could only get involved in FCC matters if you had what they thought was an economic stake or the broadcaster signals created interference. this petition, the years of organizing at its foundation, and the groundbreaking decision that followed will always be a core inspiration to me.

Mississippi is very much on my mind these days.

There have been many milestone anniversaries commemorated this year – 50th anniversary of freedom summer, the civil rights act, the assassination of Medgar Evers and more. I find myself reflecting on the deep, inextricable link between the fight for just access to media and just content grounded in human rights. as Rev. Parker, Rev. Smith and mr. Henry knew back then, racist coverage along with censorship was analogous to shouting fire in a crowded theater. the exclusion of black voices and the promotion of hate had helped to create an environment where black life was cheap.

Access and content operate together. media justice requires we address them both. Renisha Mcbride, Trayvon Martin, Michael Brown, Oscar Grant, John T. Williams, Henry Glover, Juan Herera, Amadou Diallo, Iman Morales, Eleanor Bumpers, Vincent Chin, and the four little girls murdered in a church basement 51 years ago last month Addie Mae Collins, Cynthia Wesley, Carole Robertson, Denise Mcnair there are so many more names to recall. there are so many names we don’t even know. and they number into the millions, over centuries as we are reminded over and over again that for people of color in this country, our lives are cheap. continuing the legacy of rev. Parker is to break the complicity of media – especially news media — with our dehumanization. of course, media bias does not pull the trigger but it does help paint a target on our backs. we can do so much better. we can be much better. and in doing so, there’s the opportunity to make media worthy of the public’s airwaves as rev. Parker himself imagined.

I will close with the words of one of mississippi’s greatest freedom fighters, ms. Fannie Lou Hamer, whom Jaribu Hill reminded me that yesterday would have been her 97th birthday: she said, in her inimitable way of cutting to the chase, “it’s time for america to get right.”

As Rev. Parker and his comrades showed us decades ago, media justice – just access and just content – is a critical step in that direction. I am holding the vision that when we gather to celebrate the 75th anniversary of this important decision, we will be able to say that our work helped get america right. Thank you again for this incredible honor.

Today's action by the FCC to press ahead on prison phone rate reform is welcome news. We congratulate Chairman Wheeler on his wisdom in taking his cues from Commissioner Clyburn on her strong moral leadership with regard to this issue. Predatory prison phone rates not only harm families economically, they undermine a supportive network for inmates, which in turn makes our communities less safe. We are pleased to see that the Commission is proposing to reform local telephone rates and to take further action to eliminate the subsidy of our prisons and jails via telephone rates.

Today fourteen major religious denominations and organizations joined the throngs of people in the United States and around the world in calling on the Federal Communications Commission to adopt robust net neutrality protections. The letter, coordinated by the United Church of Christ's media justice ministry, OC Inc., and the U.S. Conference of Catholic Bishops, was joined by the National Council of Churches, the Islamic Society for North America, the United Methodist General Board of Church and Society, Presbyterian Church (U.S.A.), and the Greek Orthodox Archdiocese of America, among others. 

The letter highlighted the importance of free and open Internet communications not only for church and religious organizations own operations, but also for disenfranchised and vulnerable people to access services:

Strong net neutrality protections are critical to the faith community to function and connect with our members, essential to protect and enhance the ability of vulnerable communities to use advanced technology, and necessary for any organization that seeks to organize, advocate for justice or bear witness in the crowded and over-commercialized media environment.

Noting that "the Internet is an indispensable medium for people of faith – and others with principled values – to convey views on matters of public concern and religious teachings," the letter also described the consequences of inadequate protections, "Communication is an essential element of religious freedom and freedom of conscience: we fear the day might come when people of faith and conscience, and the institutions representing them, would have no recourse if we were prevented from sharing a forceful message or a call to activism using the Internet."

The letter urged the Federal Communications Commission to adopt the strongest possible rules to prohibit paid prioritization and survive legal challenges.

This week is in important deadline for preserving net neutrality for an open Internet. These policies, being considered by the Federal Communications Commission, impact how everyone can use the Internet -- and as you may have heard in the news, a key part of the proposal will permit some companies to pay Internet companies so that their content will be faster and better for users. Here at UCC's media justice ministry, we have been long-time proponents of open Internet, and so have many of our friends in the faith community.

The event, organized by the United Church of Christ’s media justice ministry, the Office of Communication, Inc., will be held at 8 a.m. EST on Tuesday, Oct. 7 at the Newseum in Washington, D.C., in partnership with the Newseum Institute. Wheeler was appointed by President Barack Obama and became the 31st chairman of the FCC on Nov. 4, 2013. For more than three decades, he has been involved with new telecommunications networks and services, experiencing the revolution in telecommunications as a policy expert, an advocate and a businessman. He is the only person to be selected to both the Cable Television Hall of Fame and The Wireless Hall of Fame, a fact that President Obama joked made him “The Bo Jackson of Telecom.” An avid student of history, Wheeler is the author of Take Command: Leadership Lessons of the Civil War and Mr. Lincoln’s T-Mails: The Untold Story of How Abraham Lincoln Used the Telegraph to Win the Civil War. Wheeler is a former trustee of the John F. Kennedy Center for the Performing Arts, a former board member of the Public Broadcasting Service (PBS), and the former chairman and president of the Foundation for the National Archives.

Themba, executive director of The Praxis Project, will receive the Everett C. Parker Award, given in recognition of an individual whose work embodies the principles and values of the public interest in telecommunications and the media. Themba helped to pioneer the developing field of justice communications, first as media director for the Southern Christian Leadership Conference in Los Angeles and then as a media strategist supporting a range of progressive causes. At SCLC-LA, she first engaged in media policy work to support community engagement around station licensing. During her tenure as director of the Center for Media and Policy Analysis at The Marin Institute, Themba began advancing media advocacy as a mainstream practice in public health. She is co-author of Media Advocacy for Public Health: Power for Prevention, Talking the Walk: Communications Guide for Racial Justice and Fair Game: A Strategy Guide for Racial Justice Communications in the Obama Era.

Sandoval, a Commissioner of the California Public Utilities Commission (CPUC) since 2011, will receive the Donald H. McGannon Award, given in recognition of special contributions in advancing the roles of women and people of color in the media. Sandoval, the first Latino to serve as a commissioner at the CPUC, also serves as a co-vice-chair of the National Association of Regulatory Utility Commissioners (NARUC) Telecommunications Committee and as policy chair of the Federal Communications Commission’s Federal-State Joint Conference on Advanced Telecommunications Services. Sandoval, the first Latina to win a Rhodes scholarship, directed the FCC’s Office of Communications Business Opportunities during the Clinton Administration and is a tenured faculty member of the Santa Clara University School of Law. Sandoval authored and co-authored a number of important FCC filings and articles addressing inclusion in communications policy and published a major study on commercial radio ownership by people of color.  As a CPUC commissioner she helped bring about the first telephone service available to the Yurok nation in Northern California.

This year marks the 50th anniversary of Rev. Dr. Everett C. Parker’s petition to the FCC, which challenged the broadcasting license of WLBT-TV in Jackson, Miss., for its failure to serve the public interest, most notably in its coverage of that city’s African-American residents. Parker’s petition ultimately established the right of individuals to intervene in matters before the FCC.

This year’s lecture, in the Newseum’s Knight Conference Center, will be held in conjunction with the Newseum’s three-year exhibit “Civil Rights at 50,” chronicling major developments in the civil rights movement from 1963 to 1965 through news media reports.

The Everett C. Parker Ethics in Telecommunications Lecture was created in 1982 to recognize the Rev. Dr. Parker, founder of OC, Inc., and his pioneering work as an advocate for the public's rights in broadcasting. The event is the only lecture in the country to examine telecommunications in the digital age from an ethical perspective. Past speakers have included network presidents, Congressional leaders, and FCC chairs and commissioners, as well as academics, cable and telephone executives and journalists. More information is available at www.uccmediajustice.org/parker.

UCC Media Justice participated today in a tweet chat, co-sponsored by the Digital Ads campaign, which is a joint project of Center for Digital Democracy and Berkeley Media Studies Group, discussing the negative impact digital advertising has on children, and in particular children of color.   There is much to be said on this topic, including the horrible immorality of targeting children whose health is already in danger. According to the CDC, 17% of kids today obese, higher for African Americans and Latinos: 22% and 20%; 1 in 5 kids! As the American Academy of Pediatrics noted, exposure to advertising is associated w/ child obesity, poor nutrition, and cigarettes & alcohol.

Digital marketing takes advantage of big data to target children in subtle ways. Extensive studies show that younger kids have a hard time understanding advertising -- that the advertisers do not have their best interest at heart in the same way that a teacher who gives advice has. In addition, the tweet chat discussed new marketing techniques using neuroscience to subtly reach around parents into a teen's subconscious to make unhealthful food more desirable. And digital marketing is ubiquitous, as children spend more and more time online.

Digital advertising directed toward kids is based also on the techniques perfected by Big Data, which has begun to gain the attention of the civil rights community. An important safeguard is giving users, including parents, control over their own data. While data can be helpful, it can also target communities and individuals in harmful ways. A large number of public interest organizations encouraged the White House to consider health in its current study of Big Data.

Studies have shown that children of color are on the receiving end of much more advertising than white children. For example, a recent study by researcher Dale Kunkel showed that more than 84% of all foods and beverages advertised to children on Spanish-language television shows are unhealthy. Another study showed African American children and teens see at least 50% more fast food ads than their white peers.
